Bölcsödei létszám - eltérés 20 %
Jogszabályi hívatkozás:
"A személyes gondoskodást nyújtó gyermekjóléti, gyermekvédelmi intézmények, valamint személyek szakmai feladatairól és működésük feltételeiről szóló 15/1998. (IV. 30.) NM rendelet 40. § (2) szerint egy bölcsődei csoportban - a (3) bekezdésben meghatározott kivétellel - legfeljebb 10 gyermek gondozható. (3) A fogyatékos gyermeket is ellátó csoportban legfeljebb 8, a kizárólag fogyatékos gyermeket ellátó csoportban legfeljebb 6 gyermek gondozható. (4) A bölcsődei gondozás-nevelés minimumfeltételeit, valamint a szakmai munka részletes szempontjait az Intézet által kiadott módszertani levél tartalmazza, mely szerint a szakmai szempontokat figyelembe véve a bölcsődei csoportok maximális megengedhető feltöltöttsége 120% lehet. "
A Kincstár álláspontja szerint:
"A Ktv.TV-ben - Kiegészítő szabályok 8-9.pontjaiban - meg van határozva, hogy a normatíva elszámolás tekintetében a működési engedélyben szereplő létszámtól mikor és milyen mértékben lehet eltérni úgy, hogy még a normatíva jár az elszámolónak. A bölcsődei ellátás esetében nincs ilyen megengedő szabály. A Szociálpolitikai és Módszertani Intézet módszertani ajánlása nem jogszabályértékű szabályozás, ajánlása nem támasztja alá a normatíva igénylésénél a működési enygedélyben lévő maximális létszámtól való eltérést."
